Agreement to Terms

By purchasing any product on OmegaCreate, accessing the platform, or using any of our services, you automatically agree to be bound by these Terms of Service in full. If you do not agree to any part of these Terms, you must not purchase any product or use the platform.

Sales and Refunds

All sales on OmegaCreate are final and strictly non-refundable. Because every product is delivered as a digital download, this no-refund policy applies regardless of whether the files have actually been downloaded after purchase. Please review your order carefully before completing checkout.

Acceptable Use

When using our services, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Comply with all applicable laws and regulations
• Not misuse or abuse our services
• Respect intellectual property rights

Sample and Loop Clearance

Drum kits, sound kits, and one-shot kits sold on OmegaCreate are royalty-free and may be used in commercial releases without additional clearance. Sample packs and loop packs are not royalty-free by default and require proper clearance unless the product detail page specifically states otherwise.

If any non-royalty-free sample or loop is used in a commercial release, clearance must be obtained through OmegaCreate via the contact form before release. Where clearance is not obtained or is not handled properly, OmegaCreate reserves the right to enforce its rights through any legal means available, including litigation, sanctions, recording takedowns, distribution blocks, and other remedies necessary to compel proper clearance.

Anti-Piracy

Piracy of OmegaCreate products in any form is strictly prohibited. This includes, without limitation, downloading, distributing, uploading, sharing, or otherwise obtaining any product without a valid purchase.

If a pirated OmegaCreate sample, loop, or other content is used in a commercial release (including but not limited to a song, beat, soundtrack, advertisement, or other revenue-generating work), OmegaCreate reserves the right to claim a significant portion of both the composition and master ownership of that release as compensation for piracy losses, in addition to any other remedies available under copyright law.

Intellectual Property

All content, trademarks, logos, graphics, photographs, artwork, text, designs, layouts, code, and any other materials displayed on or associated with OmegaCreate's website, platform, and services (collectively, the “Materials”) are the exclusive property of OmegaCreate or its licensors, and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly authorized in writing by OmegaCreate, you may not, in whole or in part:

• Copy, reproduce, download, scrape, archive, or store any Materials by any means, manual or automated
• Distribute, publish, transmit, broadcast, or make available any Materials to any third party
• Modify, adapt, translate, reverse engineer, or create derivative works from any Materials
• Use any Materials for commercial purposes, advertising, promotion, or training of artificial intelligence or machine learning models
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices
• Use automated tools, bots, crawlers, or data harvesters to access, extract, or collect Materials
• Frame, embed, mirror, or otherwise incorporate our Materials into any other website, application, or service

Unauthorized use of any Materials constitutes copyright infringement and may result in civil liability, statutory damages, attorneys' fees, injunctive relief, and, where applicable, criminal prosecution. OmegaCreate actively monitors for unauthorized use of its Materials and will vigorously enforce its rights to the fullest extent permitted by law, including pursuing DMCA takedowns, cease-and-desist demands, and legal action.

All rights not expressly granted herein are reserved by OmegaCreate.

Third-Party Services

OmegaCreate relies on third-party providers to operate parts of the platform, including but not limited to payment processors (such as Stripe and PayPal), hosting and development infrastructure, and other technical service partners.

OmegaCreate is not liable for outages, bugs, errors, interruptions, data loss, or any other issues caused by these third-party providers. Your use of any third-party service is subject to that provider's own terms and policies.

Payment Availability

Checkout on OmegaCreate is currently processed through PayPal. Because of PayPal's own regional restrictions, sanctions compliance, and payment processing limitations, PayPal checkout may not be available in certain countries or regions, and OmegaCreate may therefore be unable to fulfil orders from those locations.

The most consistently unsupported or restricted regions currently include:

This list is not exhaustive and may change at any time at PayPal's discretion. OmegaCreate is not responsible for orders that cannot be completed because PayPal is unavailable in your region. If your checkout fails for what appears to be a regional reason, please contact us through the contact page.

Limitation of Liability

To the fullest extent permitted by law, OmegaCreate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the platform, the products, or any content or materials made available through OmegaCreate.

Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
